In the second section of Chapter V of The concept of law, Hart lays down the concept of legal obligation throughout a critique of the concept of obligation in John Austin’s predictive theory. The critique aims at the core domain of this theory, which occupies the major part of the section, and shows how wrong it is to describe the legal obligation in terms of commands and habits of obedience. At the end of this section, Hart introduces the concepts of (...) internal and external point of view, in order to criticize the methodological model used by the predictive theory – the great responsible for the mistakes of Austin’s account. The following paper makes a review of the “debate” between both theories and, at the end, it tries to demonstrate how the introduction of Hart’s new conceptions (internal and external points of view) is done to avoid the mistakes occurred in Austin’s predictive theory. RESUMONeste ensaio defende-se o argumento de que a configuração cronotópica potencializa a obra literária como forma metafórica para experimentar a vida cotidiana. Esse argumento apoia-se nas declarações em que Bakhtin destacou que a organização de processos psicológicos de personagens no enredo está relacionada com a experiência da unidade tempo-espaço, conceitualmente denominada de cronotopo. Para exemplificar essas questões desenvolveu-se aqui uma análise da configuração cronotópica do autor-personagem no Livro do desassossego de Fernando Pessoa. A dificuldade do autor-personagem para negociar as posições (...) de figura e fundo no seu pensamento refletiu uma experiência de fronteira específica, revelada na frequente associação de termos antagônicos e uso frequente de neologismos. Percebendo o funcionamento cronotópico da narrativa, discute-se o potencial da literatura na provisão de metáforas para vida real. Nessas considerações chamou-se a atenção para a participação do leitor na constituição do cronotopo e da obra.ABSTRACTIn this essay we defend the argument that chronotopic configuration enhances literary works providing metaphors for everyday life. This argument is embedded in statements in which Bakhtin emphasized that the organization of the characters' psychological processes in plots is related to the experience of temporal-spatial unity, conceptually called the chronotope. In order to address these issues, we developed an analysis of chronotopic configuration of author-character, in "The Book of Disquiet" by Fernando Pessoa. The difficulty met by the author-character in negotiating positions of figure and background in plots reflects a specific border experience, revealed in the common association of antagonistic terms and frequent use of neologisms. Considering properties of narrativity in the chronotopic analysis we can discuss the potential literature has of providing real life metaphors. Moreover, through these remarks, greater emphasis has been placed on the reader's participation in the constitution of the chronotope and on literary work. (shrink)

What we envisaged as a dossier to explore the connection between style and philosophy in this unique transitional period of Presocratic philosophy has turned out to be a volume that breaks with several conventional views of the Presocratics and has the potential to take the interpretation of style and Presocratic philosophy in a whole new and more fruitful direction.

Morality has traditionally been described in terms of an impartial and objective “moral law”, and moral psychological research has largely followed in this vein, focusing on abstract moral judgments. But might our moral judgments be shaped not just by what the action is, but who is doing it? We looked at ratings of moral wrongness, manipulating whether the person doing the action was a friend, a refugee, or a stranger. We looked at these ratings across various moral foundations, and conducted (...) the study in Brazil, US, and UK samples. Our most robust and consistent findings are that purity violations were judged more harshly when committed by ingroup members and less harshly when committed by the refugees in comparison to the unspecified agents, the difference between refugee and unspecified agents decays from liberals to conservatives, i.e., conservatives judge them more harshly than liberals do, and Brazilians participants are harsher than the US and UK participants. Our results suggest that purity violations are judged differently according to who committed them and according to the political ideology of the judges. We discuss the findings in light of various theories of groups dynamics, such as moral hypocrisy, moral disengagement, and the black sheep effect. (shrink)

Gilbert Ryle famously wrote that practical knowledge (knowing how) is distinct from propositional knowledge (knowing that). This claim continues to have broad philosophical appeal, and yet there are many unsettled questions surrounding Ryle’s basic proposal. In this article, I return to his original work in order to perform some intellectual archeology. I offer an interpretation of Ryle’s concept of action that I call ‘adverbialism’. Actions are constituted by bodily behaviours performed in a certain mode, style or manner. I present various (...) challenges to adverbialism – scenarios in which it seems we publicly behave one way, but privately feel another. And I offer a response – Ryle’s stated practice of re-describing those situations in ways that pose no threat to his adverbialism. I also present an interpretation of practical knowledge in Ryle’s work. Knowing how is a special kind of action, undertaken only when we progressively self-modify our behaviours in the presence of new challenges or opportunities. (shrink)

Sally Haslanger offers the following concept of “woman”: If one is perceived as being biologically female and, in that context, one is subordinated owing to the background ideology, then one “functions” as a woman (2012b, 235). An implication of this account is that if someone is not regarded by others as their self-identified gender, they do not function as that gender socially. Therefore, one objection to this ascriptive account of gender is that it wrongly undermines the gender identities of some (...) trans people. In this paper, I will argue that Haslanger’s definition can be defended against this objection and that her account inevitably aids in liberatory efforts not only for cisgender women, but for all sexual and gender minorities. While Katharine Jenkins’s dual account of gender aims to rectify this objection (2016, 407), I will point out two important problems with her argument: “the inclusion dilemma” and “the abolition problem.” Finally, I will argue that Haslanger’s account of gender is preferable to Jenkins’s because it outlines the reality of gender as an oppressive, hierarchical system whose categories ought to be dismantled. This paper examines the consequences of a culture of “personal ethics” when using new methodologies, such as the use of social media sites as a source of data for research. Using SM research as an example, this paper explores the practices of a number of actors and researchers within the “Ethics Ecosystem” which as a network governs ethically responsible research behaviour. In the case of SM research, the ethical use of this data is currently in dispute, as even though it (...) is seemingly publically available, concerns relating to privacy, vulnerability, potential harm and consent blur the lines of responsible ethical research behaviour. The findings point to the dominance of a personal, bottom-up, researcher-led, ‘ethical barometer’ for making decisions regarding the permissibility of using SM data. We show that the use of different barometers by different researchers can lead to wide disparities in ethical practice - disparities which are compounded by the lack of firm guidelines for responsible practice of SM research. This has widespread consequences on the development of shared norms and understandings at all levels, and by all actors within the Ethics Ecosystem, and risks inconsistencies in their approaches to ethical decision-making. This paper argues that this governance of ethical behaviour by individual researchers perpetuates a negative cycle of academic practice that is dependent on subjective judgements by researchers themselves, rather than governed by more formalised academic institutions such as the research ethics committee and funding council guidelines. The UK’s 100,000 Genomes Project has the aim of sequencing 100,000 genomes from UK National Health Service (NHS) patients while concomitantly transforming clinical care such that whole genome sequencing becomes routine clinical practice in the UK. Policymakers claim that the project will revolutionize NHS care. We wished to explore the 100,000 Genomes Project, and in particular, the extent to which policymaker claims have helped or hindered the work of those associated with Genomics England – the company established by the Department (...) of Health to deliver the project. We interviewed 20 individuals linked to, or working for Genomics England. Interviewees had double-edged views about the context within which they were working. On the one hand, policymakers’ expectations attached to the venture were considered vacuous “genohype”; on the other hand, they were considered the impetus needed for those trying to advance genomic research into clinical practice. This paper describes a novel method for the delivery of an introductory module on survey sampling at a third?level institution. As part of the module, students undertake a practical survey that is of interest not only to themselves but also to university administrators and other module coordinators. Unlike many data collection activities used in class, these data have intrinsic value. This module is shown to produce students with a high level of expertise in survey sampling. It also fosters in students (...) wider generic capacities, such as information, communication and problem?solving skills and teamwork and leadership skills that prepare them for further study and employment. The emphasis on activity?based learning has led to increased student participation, improved examination results as well as enhanced student satisfaction with the module. (shrink)

Since 1994, eleven ministerial public juridic persons have been established in Australia to take the education, health and community service ministries of the instigating religious institutes purposely into the future as ministries of the Catholic Church. Subsequently other ministries have been entrusted to established MPJPs, including some diocesan and parish health and aged care services. In the period from 2012 to 2016, representatives of the MPJPs explored means of fostering collaboration between the respective entities, leading to the founding of the (...) Association of Ministerial PJPs Ltd in May 2016. These are historic developments for the Australian Church in relation to lay ecclesial leadership, and offer a canonically recognised means of expanding lay women and men's participation in church governance. While ethical and empirical interest in so-called secondary variants and incidental findings in clinical genetics contexts is growing, critical reflection on the ethical foundations of the various recommendations proposed is thus far largely lacking. We examine and critique the ethical justifications of the three most prominent disclosure positions: briefly, the clinical geneticist decides, a joint decision, and the patient decides. Subsequently, instead of immediately developing a new disclosure option, we explore relevant foundational ethical values and norms, drawing on the normative (...) and empirical ethical literature. Four ethical signposts are thereby developed to help guide disclosure discussions. These are: respectful sharing of the clinician’s expertise; transparent communication; epistemic modesty; and respect for the embedded nature of the patient. We conclude by considering the most common current disclosure positions in the light of the four ethical signposts. (shrink)

In this article, I link the empirical hypothesis that neural representations of sensory stimulation near the body involve a unique motor component to the idea that the perceptual field is structured by skillful bodily activity. The neurophenomenological view that emerges is illuminating in its own right, though it may also have practical consequences. I argue that recent experiments attempting to alter the scope of these near space sensorimotor representations are actually equivocal in what they show. I propose resolving this ambiguity (...) by treating these representations as responsive to the development or degeneration of know-how—which can be isolated as an appropriate object for scientific investigation. I develop an interpretation of Maurice Merleau-Ponty's concept of motor intentionality, one that emerges out of a reading of his presentation of a now classic case study in neuropathology—patient Johann Schneider—in Phenomenology of Perception. I begin with Merleau-Ponty's prescriptions for how we should use the pathological as a guide to the normal, a method I call triangulation. I then turn to his presentation of Schneider's unusual case. I argue that we should treat all of Schneider's behaviors as pathological, not only (...) his abstract movements, as is commonly acknowledged in the secondary literature, but also crucially his concrete movements. Using these facts of Schneider's illness, I reconstruct a ‘fundamental function’ of consciousness, as Merleau-Ponty called it, in which there are two kinds of bodily agency: the power of the body to be solicited by a situation and the power of the body to project a situation. I propose that these powers became dissociated in Schneider's case, as evidenced by his abstract and concrete movements, while in the normal case, these powers comprise a dynamic unity, enacted as motor intentionality. I also discuss how my interpretation complements Merleau-Ponty's assertion that motor intentions exist between mind and matter. (shrink)

In this paper we argue the need to reimagine research ethics frameworks to include notions of environmental sustainability. While there have long been calls for healthcareethics frameworks and decision-making to include aspects of sustainability, less attention has focused on howresearchethics frameworks could address this. To do this, we first describe the traditional approach to research ethics, which often relies on individualised notions of risk. We argue that we need to broaden this notion of individual risk to consider issues associated with (...) environmental sustainability. This is because research is associated with carbon emissions and other environmental impacts, both of which cause climate change health hazards. We introduce how bioethics frameworks have considered notions of environmental sustainability and draw on these to help develop a framework suitable for researchers. We provide a case study of data-driven health research to apply our framework. (shrink)

Investigations of iconicity in language, whereby interactants coordinate meaningful bodily actions to create resemblances, are prevalent across the human communication sciences. However, when it comes to analysing and comparing iconicity across different interactions and modes of communication, it is not always clear we are looking at the same thing. For example, tokens of spoken ideophones and manual depicting actions may both be analysed as iconic forms. Yet spoken ideophones may signal depictive and descriptive qualities via speech, while manual actions may (...) signal depictive, descriptive, and indexical qualities via the shape, movement, and placement of the hands in space. Furthermore, each may co-occur with other semiotics articulated with the face, hands, and body within composite utterances. The paradigm of iconicity as a single property is too broad and coarse for comparative semiotics, as important details necessary for understanding the range of human communicative potentialities may be masked. Here, we draw on semiotic approaches to language and communication, including the model of language as signalled via describing, indicating and/or depicting and the notion of non-referential indexicality, to illustrate the multidimensionality of iconicity in co-present interactions. This builds on our earlier proposal for analysing how different methods of semiotic signalling are combined in multimodal language use. We discuss some implications for the language and communication sciences and explain how this approach may inform a theory of biosemiotics. (shrink)

Digital phenotyping for mental health is an emerging trend which uses digital data, derived from mobile applications, wearable technologies and digital sensors, to measure, track and predict the mental health of an individual. Digital phenotyping for mental health is a growing, but as yet underexamined, field. As we will show, the rapid growth of digital phenotyping for mental health raises crucial questions about the values that underpin and are reinforced by this technology, as well as regarding to whom it may (...) become valuable. In this commentary, we explore these questions by focusing on the construction of value across two interrelated domains: user experience and epistemologies on the one hand, and issues of data and ownership on the other. In doing so, we demonstrate the need for a deeper ethical and epistemological engagement with the value assumptions that underpin the promise of digital phenotyping for mental health. (shrink)

We review evidence of the psychological and social costs associated with punishing. We propose that these psychological and social costs should be considered (in addition to material costs) when searching for evidence of costly punishment.

In what follows I seek to answer the question on whether it is possible to integrate two different lines of research on human rationality: on the one hand, some philosophical lines of research of a cognitivist nature, and, on the other, lines of research on the logical reasoning of human agents and normative criteria. My answer to such questioning will be affirmative. To defend my point, I shall proceed as follows: first, in sec. 2 I offer the antecedents and characteristics (...) of the cognitivist notion of “intelligence” that has greater acceptance today, the general theory of intelligence, also known as the g factor. Throughout sec. 3 I present the elements thanks to which it has been considered that although g factor manages to satisfactorily evaluate the phenomenon of intelligence, it ignores relevant characteristics from the perspective of what rationality has been considered to be. Then, in sec. 4, I present some notions of rationality available in literature on the philosophy of logic, and I evaluate what are the distinctive elements of each of these characterizations. In sec. 5, I defend that it is possible to improve our understanding of cognitive styles from the elements of the philosophy of logic exposed in section four. (shrink)

The 1965 Decree on the Apostolate of Lay People stated: An indication of this manifold and pressing need is the unmistakable work being done today by the Holy Spirit in making the laity ever more conscious of their own responsibility and encouraging them to serve Christ and the Church in all circumstances.

Forensic DNA phenotyping (FDP) is an emerging technology that seeks to make probabilistic inferences regarding a person’s observable characteristics (“phenotype”) from DNA. The aim is to aid criminal investigations by helping to identify unknown suspected perpetrators, or to help with non-criminal missing persons cases. Here we provide results from the analysis of 36 interviews with those who have a professional stake in FDP, including forensic scientists, police officers, lawyers, government agencies and social scientists. Located in eight EU countries, these individuals (...) were asked for their views on the benefits and problems associated with the prospective use of FDP. While all interviewees distinguished between those phenotypic tests perceived to either raise ethical, social or political concerns from those tests viewed as less ethically and socially problematic, there was wide variation regarding the criteria they used to make this distinction. We discuss the implications of this in terms of responsible technology development. (shrink)

This paper assesses arguments that paying for housework compromises the moral integrity of either the buyer or seller or both. I find that none provides adequate justification for avoiding paying for housework. Instead, I argue that the vigorous pursuit of justice for women workers will best remedy injustice in service sector occupations, including paid housework.

This article aims to show how the changes to NEPA by the Trump Administration are an act of environmental racism, defined as “[i]ntentional or unintentional racial discrimination in environmental policy‐making, enforcement of regulations and laws, and targeting of communities for the disposal of toxic waste and siting of polluting industries.”.

In April 2020, close to the start of the first U.K. COVID-19 lockdown, the U.K. government announced the development of a COVID-19 contact tracing app, which was later trialled on the U.K. island, the Isle of Wight, in May/June 2020. United Kingdom surveys found general support for the development of such an app, which seemed strongly influenced by public trust. Institutions developing the app were called upon to fulfil the commitment to public trust by acting with trustworthiness. Such calls presuppose (...) that public trust associated with the app can emerge if the conditions for trustworthiness are met and that public trust is simplistic, i.e., linearly the sum of each member of the publics’ individual – U.K. government trust relationship. Drawing on a synthesis of the trust literature and fifteen interviews with members of the public trialling the app on the Isle of Wight, this paper aims to explore what trust mechanisms and relationships are at play when thinking about public trust in the context of the U.K. COVID-19 app. We argue that public trust is a complex social phenomenon and not linearly correlated with institutional trustworthiness. As such, attention needs to widen from calls for trustworthy infrastructures as a way to build public trust, to a deeper understanding of those doing the trusting; in particular, what or whom do people place their trust in when considering whether using the app and why. An understanding of this will help when trying to secure public trust during the implementation of necessary public health measures. (shrink)

What things make a state “nuclear,” what makes things “nuclear,” and how do we know? The degree to which—and purpose for which—a nation, a program, a technology, or a material counts as “nuclear” is not always a matter of consensus. Nuclearity depends on history and geography, science and technology, bodies and politics, radiation and race, states and capitalism. It is not so much an essential property of things, as it is distributed in things. Settlements about degrees of nuclearity structure global (...) control over the flow of radioactive materials; they constitute the conceptual bedrock of antinuclear movements and nuclear power industries; they affect regulatory frameworks for occupational health and compensation for work‐related illnesses. This essay explores these themes by contemplating the Nuclear Non‐Proliferation Treaty, the implementation of safeguards, and a few other nuclear things. (shrink)

The emerging discipline of educational neuroscience stands at a crossroads between those who see great promise in integrating neuroscience and education and those who see the disciplinary divide as insurmountable. However, such tension is at least partly due to the hitherto predominance of philosophy and theory over the establishment of concrete mechanisms and agents of change. If educational neuroscience is to move forward and emerge as a distinct discipline in its own right, the traditional boundaries and methods must be bridged, (...) and an infrastructure must be in place that allows for collaborative and productive exchange. In the present paper, we argue that school psychologists have the potential to fulfill this need and represent important agents of change in establishing better connections between research and practice. More specifically, we use theNational Association of School Psychologists (NASP) (2020)Domains of Practice to highlight several areas where school psychology can actively support forging connections between neuroscience and educational practice. Patients are increasingly turning to medical crowdfunding as a way to cover their healthcare costs. In the case of Charlie Gard, an infant born with encephalomyopathic mitochondrial DNA depletion syndrome, crowdfunding was used to finance experimental nucleoside therapy. Although this treatment was not provided in the end, we will argue that the success of the Gard family’s crowdfunding campaign reveals a number of potential ethical concerns. First, this case shows that crowdfunding can change the way in which communal healthcare resources (...) are allocated. Second, within the UK’s National Health Service, healthcare is ostensibly not a market resource; thus, permitting crowdfunding introduces market norms that could commodify healthcare. Third, pressures inherent to receiving funds from external parties may threaten the ability of patients-cum-recipients to voluntarily consent to treatment. We conclude that while crowdfunding itself is not unethical, its use can have unforeseen consequences that may influence conceptions of healthcare and how it is delivered. (shrink)
